Unmarker.it Sponsorship Terms of Sale

1. Provider and contact details
The service is provided by NOMADE - S.R.L. ("NoMaDe"), whose registered office is at Via Luigi Salvatore Cherubini 10, 50121 Florence (FI), Italy. Its Italian tax code, VAT number and Florence Business Register number are 07505480488; REA FI - 708292. Its share capital is €100,000.00, fully paid.

2. Business and professional purchases only
Sponsorships are offered exclusively to businesses and self-employed professionals purchasing in the course of their business or professional activity (B2B). The customer must provide accurate identification and billing information and confirms that they are authorised to purchase on behalf of the named buyer.
Purchases for purposes outside a business or professional activity are not part of this offer. A customer's declaration alone does not remove any mandatory protections that may in fact apply.
The service is offered to customers in Italy, the European Union and countries outside the EU, subject to applicable legal restrictions and supported countries and payment methods.
3. Service, duration and visibility
The customer purchases the publication of a sponsor card in Unmarker.it's sponsor placements. The card contains a project name, an icon, a link to the customer's website and a description of no more than 90 characters.
The campaign lasts 30 consecutive days (720 hours) from confirmed payment. The purchase summary states its start and end times. The campaign ends automatically. There is no subscription, automatic renewal or automatic charge. Another campaign requires a new, express purchase.
Position and presentation may vary with the device, layout and number of sponsors. Where a card alternates between two sponsors, each side has the same nominal display time. No equal number of actual impressions is guaranteed for each sponsor, nor is any minimum number of visits, clicks, enquiries or sales. Visibility also depends on how visitors use the site.
4. Price, payment and invoicing
The price before tax is €500.00 per campaign, plus VAT where applicable. Applicable taxes and the total payable are shown before purchase confirmation, based on the customer's details and applicable rules. The price does not vary by placement.
Payment is a single advance payment through Stripe Payments. NoMaDe remains the seller of the service and the entity responsible for issuing the invoice. A Stripe payment receipt does not replace NoMaDe's tax and invoicing obligations.
Before payment, the customer can review their details, advertising materials and these terms. A placement may be held temporarily during Checkout. An unconfirmed payment does not activate the campaign.
NoMaDe sends confirmation of the purchase, including the campaign details and applicable terms, in a form the customer can retain.
5. Advertising materials
The customer must have the necessary rights to the name, icon, description and promoted website and authorises NoMaDe to use those materials to deliver the campaign. The content must not be unlawful, misleading or infringe the rights of others, and the linked site must not lead to fraud, malware or unlawful collection of data.
Publication is automatic after payment confirmation and does not mean that NoMaDe endorses or recommends the advertised product. NoMaDe will inform the customer of measures required because of unlawful content or an order from an authority, to the extent permitted by law. Remedies under the law and these terms remain available; the price is not automatically forfeited whenever a concern is raised about the content.
6. Voluntary cancellation and change of mind
A business or professional customer may request early removal of the sponsor card by emailing help@nomadesrl.it and providing the purchase reference. Cancellation because the customer has changed their mind or plans, or because results are below expectations, does not entitle the customer to a full or partial refund of the price.
This provision concerns only the customer's voluntary cancellation. It does not exclude refunds for service interruptions under clause 7, remedies for NoMaDe's breach of contract, or any other applicable mandatory rights. The consumer cooling-off period under the Italian Consumer Code does not apply to transactions that are genuinely B2B.
7. Service interruptions and proportional refunds
The customer is entitled to a proportional refund of the price for any period during the purchased campaign when an interruption of Unmarker.it prevents publication of the sponsor card. This includes interruptions at technical providers that make publication on the site unavailable.
Fractions of a day are included in the calculation:
Refund before tax = €500.00 × hours of unavailability / 720 hours.
Only intervals within the campaign are counted; overlapping intervals are not counted twice. Amounts already refunded for the same intervals are deducted. The refund of the price cannot exceed the amount paid for the campaign, and applicable tax adjustments are added. The final amount is rounded to the nearest cent in the adjustment document.
Normal sponsor rotation, a card outside the visible area, a lack of visitors or clicks, a visitor's local ad blocker, unavailability of the customer's own website and removal voluntarily requested by the customer are not downtime.
The customer can report an interruption to help@nomadesrl.it, stating the campaign reference and the period observed. NoMaDe checks the intervals against available technical data and the customer's information and communicates the refund calculation. Visitors' personal data are not required.
A partial refund for downtime does not stop a restored campaign or change its original end time. The customer receives money rather than being required to accept a voucher or a campaign extension instead of the refund.
Statutory remedies for breach of contract and mandatory limits on exclusions of liability, including for wilful misconduct and gross negligence, remain unaffected. This clause does not impose a general limit on damages.
8. Privacy and communications
The processing of personal data is described in Unmarker.it's privacy and cookie policies. Acceptance of these terms is separate from optional consent to analytics. Refusing analytics does not prevent a purchase.
9. Governing Law: Italian Law; updates
This contract is governed by Italian law, subject to any mandatory rules and protections that apply to the relationship. Court jurisdiction is determined by the applicable rules; these terms do not designate an exclusive court.
Updated terms apply to purchases made after their effective date. The version accepted at the time of purchase remains available for each campaign.
